It's unfortunate that QYER is not paying for the time and money invested by you in developing/doing the material/project ordered by them. Before you enter into an agreement it is advisable to execute a contract and keep the place of execution of such agreement as per your convenience (e. g. you registered office). Also, it is prudent to add clauses governing the dispute. I understand that it is really tough to make them cough the fee but still, after inspecting the agreement copy, copy of the mails, messages, letters, negotiation papers etc. possible solution could be arrived at. My first question to you would be whether or not you posses a contract in a written form. Another important thing regarding contracts with a foreign element is determining applicable law. I assume that applicable law here would be Swiss Law, since you as a service provider are seated in Switzerland. This declaration has to be checked, of course. However, contractual parties are free to determine applicable law and for this purpose I would have to check in your contract whether or not you have stipulated an article of such nature. Last but not the least, it would be necessary to determine the competent jurisdiction. This is extremely important because it determines where, i.e. in which country you will file the Lawsuit. The common thing when it comes to international contracts is stipulating a competency of an international arbitration, but that is another fact that depends on whether or not parties have agreed on that.
