Hi, a while ago I found out that there is a pre-existing default judgement on me. This case is in Miami Florida. I believe I was not properly served and furthermore, the case passed various time limits so it might not even be valid. Additionally I was never given a signed contract(I was given an invoice only). The alleged debt is for a claimed leftover balance for college.
I filed a motion to set aside the judgement as I did not live at the address that the plaintiff claimed substitute service on, however, it was denied for some reason. The address is owned by my parents and is rented to tenants who did not notify me or anyone in my family of the service. I feel my right to a hearing was violated.
I would like you to review all my documentation and advise me on what laws my appeal should be based on as well as help me with the proper wording and formatting for the initial brief.
